§ 12-335. Processions; identification, manner of driving in, right-of-way.

  • (a)

    In this section a vehicle or funeral procession is a group of motor vehicles led by a vehicle of a law enforcement agency with territorial jurisdiction, whose blue warning lights are in operation with the vehicle traveling in a single file with headlights on to identify it as a member of the procession; except that vehicles may be identified in such other method or way as may be determined and designated by the chief of police of the city police department as set forth in subsection (b).

    (b)

    The chief of police shall require funeral processions or vehicle processions to have a marked police car lead such processions with the blue light on. Each car in the procession shall have its headlights on to identify it as a member of the procession.

    (c)

    No vehicle not a part of the procession shall be driven through a vehicle procession except the emergency vehicles set forth in G.S. §§ 20-156 and 20-157, when operated in conformity with the provisions of such statutes. The operator of any vehicle who shall violate this subsection shall be guilty of an infraction and shall receive a penalty of thirty-five dollars ($35.00) and costs.

    (d)

    The operator of any motor vehicle traveling on or entering on the streets or highways of the city shall yield the right-of-way to a vehicle procession which is properly identified.

    (e)

    A vehicle procession shall have the right-of-way at any intersection regardless of the method of traffic control which is present or in operation at the intersection.

    (f)

    Any operator of a motor vehicle who fails to yield the right-of-way to a vehicle procession shall be liable for an infraction and shall receive a penalty of thirty-five dollars ($35.00) and costs.
